AWARE HOUSE LLC — CUSTOMER TERMS OF SERVICE

1. Marketplace Overview
Aware House LLC operates as a curated multi-vendor marketplace. Products may be made, fulfilled, or shipped
by independent Vendors. While Aware House selects Vendors based on quality and transparency standards, all product representations, sourcing information, and compliance responsibilities remain the responsibility of the Vendor.
2. Eligibility to Purchase
Customers must be at least 18 years of age and provide accurate information. Fraudulent or harmful purchasing
behavior may result in order cancellation and customer account restriction.
3. Product Information, Accuracy & Availability
Product information is derived primarily from Vendors. Physical variations, material updates, and supply
changes may occur. Items may sell out or be discontinued without notice. If a purchased item becomes unavailable,
a refund will be issued.
4. Pricing, Payments & Taxes
Order placement authorizes Aware House to charge the provided payment method. Taxes may apply depending on
customer jurisdiction. Aware House may correct pricing errors and cancel/refund orders processed with incorrect
pricing.
5. Shipping & Fulfillment
Orders may be shipped by Aware House or by Vendors to fulfill from their facilities. Shipping timelines are estimates and may vary. Tracking will be provided when applicable. Aware House is not liable for shipping delays or mis-delivery caused by incorrect addresses or carrier issues.
6. Returns, Exchanges & Refunds
All returns are governed by the Aware House Shipping & Returns Policy. Eligibility depends on product
condition, category, and return timeline. Some products—including custom, made-to-order, seasonal, or clearly
marked items—may be final sale. Unauthorized returns may be rejected.
7. Damaged, Defective, or Lost Shipments
If an item is lost or damaged, customers must follow the procedure outlined in our Shipping & Returns
Policy. Aware House may file claims with shipping carriers and will issue refunds or replacements according to
policy and product availability.
8. Vendor Responsibility & Authenticity of Claims
Vendors are solely responsible for product safety, sourcing accuracy, claims of origin, labor transparency,
environmental attributes, and compliance with U.S. law. Aware House does not independently audit production
facilities or conduct formal certifications. Customers should review product details and conduct research where needed.
9. Brand Policy, Product Claims & Supplier Disclosures
Aware House occasionally uses descriptive language such as “sustainable,” “carefully sourced,” “eco-friendly,”
or “transparent.” These terms reflect editorial tone and marketplace positioning—not formal certifications or verified standards. Customers must conduct their own assessment of product quality or ethical labor or suitability practices.
Aware House relies on Vendor-provided disclosures, published brand information, website content, and public
sources. Aware House does not perform in-person manufacturing inspections or formal compliance audits. If a Vendor misrepresents any fact, Aware House bears no liability beyond standard refund or replacement remedies.
Product images are Vendor-supplied or taken by Aware House. Visual differences due to screens, monitors,
calibration, resolution, or personal perception are not grounds for liability or misrepresentation claims.
10. Intellectual Property
All website content, including product listings, images, written descriptions, design layouts, marketing copy,
and curated collections are owned by Aware House or used with permission. Unauthorized copying, scraping, redistribution, or commercial reuse is prohibited.

11. Privacy & Data Protection
Our collection and handling of personal data is governed by our Privacy Policy. Vendor partners only receive
customer data required for order fulfillment and may not use such information for marketing, solicitation, or off-platform outreach.
12. Prohibited Conduct
Customers must not misuse the website, attempt data scraping, disrupt platform security, impersonate others,
or harass Vendors or staff. Violations may result in account suspension or legal action.
13. Medical, Safety, Cosmetic & Children’s Product Disclaimers
Products sold on Aware House may include items used for cosmetic, fragrance, home, kitchen, wellness, or
children-related purposes. Unless explicitly stated by the Vendor and supported by proper certification, Aware House makes no guarantees that any product is:
• hypoallergenic
• dermatologically tested
• FDA-evaluated
• therapeutic or functional
• age-appropriate for children
• toxin-free, chemical-free, or allergen-free
Aware House does not certify that any item is safe for infants, small children, or persons with medical
sensitivities. Customers must review ingredient information, age suitability, warnings, and perform patch testing when applicable. Any concerns should be discussed with a qualified medical professional prior to use.
No product sold through Aware House is intended to diagnose, treat, cure, or prevent illness. If a Vendor
supplies such claims, the Vendor is solely responsible for their accuracy, legality, and regulatory compliance.
14. Warranty Disclaimer
To the fullest extent permitted by law, Aware House disclaims all warranties, including merchantability,
fitness for purpose, durability, safety, sourcing traceability, environmental responsibility, and ethical labor standards. Products are sold “as-is” based on Vendor representations.
15. Limitation of Liability
Aware House shall not be liable for indirect, incidental, consequential, or punitive damages. Maximum liability
for any claim involving a product sale shall not exceed the purchase price paid by the customer for that item.
16. Third-Party Links & External Content
Referenced websites, supplier listings, external certifications, and linked resources are not controlled by
Aware House. We assume no responsibility for information accuracy or policies of external sites.
17. Arbitration Agreement
Any dispute, claim, or controversy arising from purchases, platform usage, Vendor interactions, product
quality, or alleged damages shall be resolved exclusively through binding arbitration conducted in the State of Delaware. Both parties waive their right to a jury trial or class action participation. Judgment on the arbitration award may be entered in any court with proper jurisdiction.
18. Governing Law & Venue
These Terms are governed by the laws of the State of Delaware. In any instance where arbitration is not enforceable, the sole forum for legal proceedings shall be a state or federal court located within Delaware. Customers consent to personal jurisdiction and venue in Delaware courts.
19. Changes to Terms
Aware House may revise these Terms at any time. Continued use of the website or purchases following posted updates constitutes acceptance of revised Terms.

AWARE HOUSE LLC — VENDOR TERMS OF SERVICE

By working with Aware House LLC (“Aware House” or “AH”), the seller (“Vendor”) agrees to all terms outlined in this document and acknowledges that these terms will govern their participation on the Aware House platform.
1. Definitions
Vendor / Seller: A business or individual offering products for sale through Aware House.
Aware House / AH / Admin: Aware House LLC, its authorized employees, and agents.
2. Seller Policy
Aware House is a curated online marketplace featuring high-quality, handmade, premium, and/or USA-made lifestyle goods. All participating Vendors must comply with the policies outlined herein.
Aware House reserves the right to terminate a Vendor relationship at any time and for any reason.
3. Product Eligibility, Materials & Ethical Standards
i) Supply Chain Transparency
Vendors must:
• Maintain transparent sourcing, production, and labor practices.
• Disclose the manufacturing process (e.g., handcrafted, batch production, made-to-order).
• Identify any countries of origin for materials or key product components.
• Source the majority of materials (greater than 85%) from traceable, transparent suppliers where practical.
• Avoid undisclosed sourcing from suppliers that lack traceability or where supply chains are difficult to verify.
ii) Product Categories
Approved product categories include, but are not limited to:
• Kitchen & dining
• Bed & bath
• Art & living
• Specialty, premium, or niche lifestyle goods
Products must be reviewed and approved by Aware House prior to being listed on the platform.
iii) Prohibited Items
Vendors must not sell, list, or attempt to list any of the following on Aware House:
• Weapons, hazardous items, or dangerous goods.
• Illegal drugs, drug paraphernalia, or unregulated medical drugs.
• Hate items or items that promote, support, or glorify hatred or violence.
• Items that promote illegal activity or are otherwise unlawful.
• Excessively explicit or mature content that is not aligned with Aware House brand standards.
• Items that violate intellectual property, safety, import, or labeling laws.
Failure to comply with these restrictions may result in immediate removal of listings and/or immediate termination of the Vendor relationship.
iv) Intellectual Property
Vendor confirms that all products and related content (including images, descriptions, and branding) are either owned by the Vendor or used with proper authorization, and that they do not infringe upon any third-party copyrights, trademarks, patents, or other intellectual property rights.
Vendor agrees to indemnify and hold Aware House harmless from any claims, damages, or expenses arising from alleged or actual intellectual property infringement related to the Vendor’s products or content.
4. Platform Management
i) Inventory & Listings
Vendor must update their own listings (Shopify collective Vendors) or communicate on a regular basis with Aware House to:
• Maintain accurate and up-to-date inventory counts.
• Ensure that no sales are made on products marked as having zero inventory.
• Provide accurate descriptions, images, and pricing for all products.
• Obtain Aware House approval prior to listing new products or making substantial changes to existing products.
ii) Packaging & Labeling Compliance
Vendor is responsible for ensuring that all products comply with applicable product safety, labeling, and packaging laws and regulations within the United States. This includes, where relevant, ingredient lists, safety warnings, care instructions, age restrictions, and any other required disclosures.
5. Customer Communication & Data Protection
i) Customer Contact
Vendor agrees not to directly contact, solicit, or engage with customers who purchase their products via Aware House, unless explicitly authorized in writing by Aware House. All order-related communications (including order status, tracking questions, and returns) will be managed by Aware House.
Vendor will not use customer information obtained through Aware House for any direct marketing, solicitation, or off-platform sales efforts without Aware House’s prior written consent.
ii) Privacy and Data Use
Vendor will:
• Protect all customer information (including names, addresses, phone numbers, and email addresses).
• Use such information solely for the purpose of fulfilling orders and shipping products.
• Not store, sell, or transfer customer data to third parties, except as necessary to fulfill shipping.
• Not add Aware House customers to email or physical mailing lists or payment systems outside of Aware House.
Vendor agrees to indemnify Aware House for any claims, fines, or damages arising from Vendor’s improper handling or misuse of customer data.
6. Shipping, Fulfillment & Lead Times
i) Shipping Labels - For vendors operating outside of Shopify Collective
Aware House will provide prepaid shipping labels (via USPS or UPS Ground/Standard, unless otherwise specified by the customer) within one (1) business day of an order being placed.
ii) Fulfillment Timeline
Vendor agrees to store, package, and ship all customer orders from their facility within a maximum of five (5) business days of receiving the shipping label from Aware House, unless otherwise agreed in writing for specific made-to-order or lead-time-sensitive products.
iii) Additional Lead Times
Vendor will notify Aware House of any products that have additional lead times, such as made-to-order or customized items, so that these lead times can be accurately communicated to customers prior to purchase.
iv) Shipping Delays
In the event of delays due to unforeseen circumstances (including but not limited to vacation, illness, or emergency), the affected party must promptly inform the other party. Vendor should notify Aware House as soon as possible so that realistic expectations can be communicated to customers.
v) Customer Service
Aware House is responsible for all communications to the customer regarding order placement, status, tracking, and returns. Vendor is not responsible for direct customer-facing service but must cooperate with Aware House by providing timely information regarding inventory, shipping, and any order issues.
vi) Specialty Products & Shipping
For certain specialty products, Vendor and Aware House may mutually agree that Vendor will handle shipping and arrange transportation directly. Such arrangements must be agreed upon in advance for the specific items concerned. In these cases, Vendor will provide tracking details to Aware House, and Aware House will share this information with the customer.
7. Damaged, Lost, and Insurance Claims
Vendor is responsible for secure and adequate packaging to ensure products arrive undamaged.
If a package is lost or a product arrives damaged, the customer must follow Aware House’s published Shipping & Returns Policy to request a replacement or refund.
Aware House will file any applicable insurance claims with the relevant carrier. All packages are covered by a minimum of $100 in shipping insurance, and Aware House will purchase additional insurance based on the retail value of the items as needed.
Sale proceeds for lost or damaged items may be withheld by Aware House until the insurance claim is processed and the customer has been refunded or the item replaced.
Resolution may take one of the following forms:
• Replacement: Vendor replaces the item, and no refund is issued to the customer.
• Refund: Aware House refunds the customer in full, and the item is not replaced.
8. Returns & Exchanges
All returns and exchanges will be handled in accordance with Aware House’s published Shipping & Returns Policy, which may be updated from time to time at Aware House’s discretion.
Vendor acknowledges that Aware House controls the return process and determines customer eligibility for returns, exchanges, or refunds based on that policy.
Vendor will not be responsible for the shipping costs associated with exchanges or returns. Aware House will manage the generation of return labels, the processing of refunds to customers, and any related customer communications.
9. Advertising, Marketing & Promotional Content
Vendor grants Aware House permission to use Vendor’s product images, brand name, logos, and related content for marketing and promotional purposes across Aware House’s website, email campaigns, social media channels, and other marketing platforms.
Aware House may edit, rephrase, or adapt Vendor-provided content for clarity, consistency, or marketing purposes but will not knowingly misrepresent Vendor or Vendor’s products.
Aware House reserves the right, at its sole discretion, to choose which products or Vendors to feature in campaigns, collections, or other promotional initiatives.
11. Termination
Vendor may terminate their participation on the Aware House platform by providing a minimum of fifteen (15) days’ written notice via email.
Aware House reserves the right to terminate the relationship with Vendor at any time, with or without cause. Upon termination, Aware House will remove Vendor’s product listings from the platform and will work to complete any outstanding customer orders already placed prior to the termination effective date.
12. General Liability & Indemnification
Vendor is solely responsible for the design, manufacture, safety, quality, and performance of their products. Vendor agrees to comply with all applicable laws and regulations governing the production, labeling, marketing, and sale of their products within the United States.
Vendor agrees to indemnify, defend, and hold harmless Aware House and its employees, officers, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:
• Product defects or failures.
• Non-compliance with applicable laws or regulations.
• Intellectual property infringement claims.
• Vendor’s misuse or mishandling of customer data.
• Any breach of these Terms & Conditions by Vendor.
13. Aware House Policy Updates
Aware House may update these Vendor Terms & Conditions and related policies from time to time. Aware House will notify Vendors of material changes. Continued use of the Aware House platform and continued selling after such notifications constitutes Vendor’s acceptance of the updated terms.
14. Acceptance
By listing products for sale and conducting business through Aware House, Vendor confirms that they have read, understood, and agreed to these Vendor Terms & Conditions and any related policies as may be updated from time to time.
